TERMS:

WhiteSmoke offers the following terms to you as a buyer / user of its WhiteSmoke Enrichment™ Software (“Software”).

LIMITED WARRANTY / UPGRADE POLICY:

The Software shall operate in accordance with the functional specifications as published at WhiteSmoke’s website. If during the period of one-year after your purchase of the Software, a defect appears with respect to its functionality, then you will be eligible to receive a free upgrade. This warranty does not cover any Software that has been altered or changed in any way, other than by WhiteSmoke.

WhiteSmoke is not responsible for problems associated with or caused by incompatible operating systems or equipment, or for problems caused by the interaction of the Software with software not furnished by WhiteSmoke.

No oral or written information, or advice given by WhiteSmoke or its dealers, affiliates, distributors, employees or agents shall extend, modify or add to this warranty.

Any risk arising out of your use of Software is born entirely by you. The Software is not “fault tolerant” and should not be used in any environment that requires this.

ENHANCEMENTS:

WhiteSmoke may, from time to time, advise you of updates, upgrades, enhancements or improvements to the Software, or may offer new releases of the Software.

SUPPORT AND MAINTENANCE:

Support and maintenance of the Software are provided by WhiteSmoke free of charge during the first twelve months following your purchase of the Software. "Support" consists of technical support, analysis, and resolution of problems where reasonably possible. For problems, you should contact WhiteSmoke through its website. WhiteSmoke will make its best efforts to respond to reasonable requests for assistance. "Maintenance,"consists of free software upgrades to new versions of the Software if and when these are released.

If after the first 12 months following your purchase of the Software, you wish to continue to receive support and maintenance, WhiteSmoke will bill you the amount of US$14.99 on each anniversary of your purchase of the Software. WhiteSmoke’s obligation to provide you with support and maintenance will lapse if you notify WhiteSmoke in writing that you do not wish not to extend the support and maintenance period.
